Venice Court confirms Italian Citizenship jure sanguinis for descendants of Italian ancestor

Introduction:

In a recent ruling, the Court of Venice examined a petition filed by several applicants seeking recognition of Italian citizenship by descent from an Italian ancestor born in the Province of Treviso in the nineteenth century who later emigrated to Brazil. The applicants demonstrated their direct genealogical link to the Italian ancestor through multiple generations, relying on civil registry documentation duly translated and legalized.

Outcome:

The Court upheld the claim and declared that the applicants are Italian citizens jure sanguinis. It also ordered the Ministry of the Interior and the competent Civil Status Registrar to proceed with the necessary registrations and transcriptions in the civil status registers and to notify the competent consular authorities. Legal costs were offset between the parties.

Challenge:

The case involved historical legal limitations affecting citizenship transmission through the maternal line under Law No. 555 of 1912. These provisions historically prevented Italian women from transmitting citizenship to their children and caused interruptions in lineage recognition. However, subsequent rulings of the Constitutional Court and the Supreme Court clarified that such discriminatory provisions are unconstitutional and cannot prevent descendants from asserting their citizenship rights.

Action:

The applicants provided documentary evidence establishing an uninterrupted line of descent from their Italian ancestor and demonstrated that the ancestor never renounced Italian citizenship nor became naturalized abroad.
