Salerno Court recognizes Italian Citizenship for Canadian descendants of a 19th-century emigrant

Introduction:

The applicants sought judicial recognition of Italian citizenship as direct descendants of an Italian citizen born in Campania in the late 19th century who later emigrated to Canada. The Ministry of the Interior entered an appearance but did not substantively oppose the claim, limiting its observations to verification of documentation and absence of impediments.

Outcome:

The Court granted the petition in full and declared the applicants Italian citizens iure sanguinis, ordering the Ministry of the Interior and the competent Civil Status Registrar to carry out all registrations, transcriptions, annotations, and required communications. Legal costs were fully offset, in light of the nature of the proceedings and the absence of substantial opposition.

Challenge:

The Court addressed preliminary issues concerning territorial jurisdiction, admissibility of judicial action without prior consular application, and the applicants’ interest in bringing proceedings. It reaffirmed that no administrative prerequisite exists for recognition of a fundamental status right and acknowledged that Italian Consulates in the applicants’ country of residence face waiting times exceeding ten years. Such prolonged delays were deemed equivalent to a denial of justice, legitimizing direct recourse to the Court.

Action:

The legal team reconstructed the full genealogical chain through duly apostilled civil records, demonstrating uninterrupted descent from the Italian ancestor and absence of any renunciation or naturalization interrupting transmission. Relying on Supreme Court Joint Sections precedent (2009 and 2022), the Court confirmed that citizenship by descent is a fundamental, permanent, and imprescriptible right, lost only through a conscious and explicit act. Having verified both descent and continuity, the Court ordered formal recognition.
