Turin Court recognizes Italian citizenship for an extensive multi-generational family

Introduction:

The applicants sought judicial recognition of Italian citizenship as descendants of an Italian citizen born in Caselle Torinese in the late 19th century who emigrated to the United States. The proceedings were filed before the Specialized Immigration Section of the Court of Turin, which affirmed its jurisdiction based on the municipality of birth of the Italian ancestor, pursuant to the post-2022 procedural framework.

Outcome:

The Court upheld the petition in full and declared all applicants Italian citizens, ordering the Ministry of the Interior and the competent Civil Status Registrar to carry out all required registrations, transcriptions, and annotations in the civil status registers, including communications to the relevant consular authorities. Legal costs were fully offset in light of the nature of the proceedings and the Ministry’s failure to appear.

Challenge:

The applicants demonstrated that the competent U.S. Consulates had failed to schedule appointments or process their citizenship applications within the statutory time limits (including the 730-day limit set by Presidential Decree No. 362/1994). The Court reaffirmed that excessive administrative delay amounts to a constructive denial of justice, entitling applicants to seek direct judicial recognition. It also addressed procedural issues concerning minor applicants and confirmed that a single parent’s representation is sufficient when the action is advantageous to the child.

Action:

The legal team reconstructed the entire genealogical chain through certified, translated, and apostilled civil records, demonstrating descent from the Italian ancestor and the absence of any naturalization or renunciation interrupting the chain of transmission. Relying on Article 1 of Law No. 91/1992 and Supreme Court Joint Sections precedent (2022), counsel established that recognition requires proof of lineage and absence of interruptive events. The Court accepted the documentation and ordered full implementation of citizenship recognition.
