No. Starting your case and filing your lawsuit are two different steps.
First, your individual case should be assessed and the legal strategy defined. Starting the legal process does not mean that your court petition must be filed immediately.
The timing of filing is a separate strategic decision.
Potentially, yes. Italian courts have already recognized citizenship in post-reform cases based on prior activation before March 27, 2025.
Whether prior activation is relevant depends on the specific circumstances of your case and the evidence available. It may provide an independent ground for recognition, separate from the question currently before the CJEU.
An Italian judge may therefore recognize your citizenship without waiting for the CJEU ruling.
No. Your appeal deadline runs independently from the CJEU proceedings. If you do not appeal within the applicable deadline, the judgment becomes final.
Once the judgment is final, your case cannot benefit from a later favorable CJEU ruling.
No. Your lawyer represents you in Italy through a power of attorney, and the citizenship proceeding is based on written submissions and documentary evidence. You do not need to travel to Italy or appear in court personally.
